{"id":516,"date":"2023-03-24T10:23:32","date_gmt":"2023-03-24T10:23:32","guid":{"rendered":"https:\/\/org.nhslothian.scot\/keydocuments\/an-anti-bribery-statement-from-the-board\/"},"modified":"2025-05-29T08:37:43","modified_gmt":"2025-05-29T07:37:43","slug":"an-anti-bribery-statement-from-the-board","status":"publish","type":"page","link":"https:\/\/org.nhslothian.scot\/keydocuments\/an-anti-bribery-statement-from-the-board\/","title":{"rendered":"An Anti-Bribery Statement from the Board"},"content":{"rendered":"\n<p>Lothian NHS Board conducts its business with integrity, transparency and fairness.<\/p>\n\n\n\n<p>We are committed to the prevention of&nbsp;bribery and corruption&nbsp;as we recognise the importance of maintaining our reputation and the confidence of our stakeholders, particularly patients, the general public, those with whom we conduct business, and our employees.<\/p>\n\n\n\n<p>We do not accept bribery and corruption in the conduct of our activities and functions, either within the organisation or in our relationships with any external parties.&nbsp;&nbsp;We will not work with others who do not share our commitment to preventing bribery and corruption.<\/p>\n\n\n\n<p>If you have any concerns with regard to bribery and corruption in relation to the Board\u2019s activities, there are several ways in which you can raise this:<br><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Reporting any concerns to the Board\u2019s Fraud Liaison Officer (Jim Old \u2013 telephone 07964 255318) or\u00a0<a href=\"https:\/\/cfs.scot.nhs.uk\/index.php\" target=\"_blank\" rel=\"noreferrer noopener\">Counter Fraud Services<\/a>\u00a0(CFS Fraud Hotline \u2013 08000 15 16 28)<\/li>\n\n\n\n<li>If the issue relates to the behaviour of a member of the Board, and compliance with the Board Member\u2019s Code of Conduct, reporting the matter to the&nbsp;<a href=\"http:\/\/www.publicstandardscommissioner.org.uk\/\" target=\"_blank\" rel=\"noreferrer noopener\">Public Standards Commissioner<\/a>.<\/li>\n\n\n\n<li>As a Board employee, making use of the Whistleblowing Policy. You can call the Whistleblowing Alert and Advice Services for NHS Scotland \u2013 telephone 0800 008 6112.<br><\/li>\n<\/ol>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:50%\">\n<p class=\"has-standard-black-color has-text-color has-regular-font-size\" style=\"font-style:normal;font-weight:500\"><strong>Prof. John Connaghan<br>Board Chair<\/strong><\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:50%\">\n<p class=\"has-standard-black-color has-text-color has-regular-font-size\" style=\"font-style:normal;font-weight:500\"><strong>Caroline Hiscox<br>Chief Executive<\/strong><\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group has-light-accent-grey-background-color has-background\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<p>It is a criminal offence to either make a bribe or to receive a bribe.&nbsp;&nbsp;The Bribery Act 2010 sets out technical definitions for both, however in simple terms a bribe has the following elements:<br><\/p>\n\n\n\n<p>&#8211; to give\/ promise\/ offer an advantage (financial or otherwise) to someone, OR<\/p>\n\n\n\n<p>&#8211; to request\/ agree to receive\/ accept an advantage (financial or otherwise) from someone<br><br>AND, with the intention&nbsp;(by either the giver or receiver) to:<\/p>\n\n\n\n<p>a) Encourage the recipient to&nbsp;<strong>improperly perform&nbsp;<\/strong>a function or an activity, OR<\/p>\n\n\n\n<p>b) Reward the recipient who has already improperly performed a function or an activity.<br><\/p>\n\n\n\n<p>It is also an offence when it is known by the giver or receiver that acceptance of the advantage would itself constitute improper performance of a relevant function or activity.&nbsp;&nbsp;An example of this would be the offer or acceptance of hospitality &amp; entertainment that goes beyond the limits of what is considered modest, normal and reasonable in the circumstances, as defined by the relevant code of conduct.<br><\/p>\n\n\n\n<p>When bribery happens it leads to&nbsp;<strong>corruption<\/strong>.&nbsp;&nbsp;This is where people abuse their position for their personal benefit\/ reasons, rather than properly performing their role for the benefit of the Board and the stakeholders it serves.<\/p>\n<\/div><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Lothian NHS Board conducts its business with integrity, transparency and fairness.
